1. Acceptance of Terms
By accessing and using the services provided by Ricamabbia ("we," "our," or "us"), you ("user," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Description of Services
Ricamabbia provides ergonomic furniture upgrade services throughout Canada, including but not limited to:
- Office chair ergonomic modifications and upgrades
- Desk and workstation ergonomic enhancements
- Home furniture comfort improvements
- Ergonomic assessments and consultations
- Custom furniture modification solutions
3. Service Agreement and Booking
3.1 Consultation Process
All services begin with a consultation to assess your furniture upgrade needs. During this consultation, we will:
- Evaluate your existing furniture
- Discuss your comfort requirements and ergonomic goals
- Provide recommendations for appropriate upgrades
- Present a detailed quote for services
3.2 Service Booking
Services are booked upon acceptance of our written quote and receipt of required deposit. All quotes are valid for 30 days from the date of issue.
3.3 Scheduling
We will work with you to schedule service appointments at mutually convenient times. We require at least 48 hours' notice for any schedule changes.
4. Payment Terms
4.1 Pricing
All prices are quoted in Canadian dollars (CAD) and include applicable taxes unless otherwise specified.
4.2 Payment Schedule
- A deposit of 50% is required to secure your booking
- The remaining balance is due upon completion of services
- Payment can be made by cash, check, or electronic transfer
4.3 Late Payment
Late payment fees of 1.5% per month may be applied to overdue accounts.
5. Warranties and Guarantees
5.1 Service Warranty
We warrant our workmanship for a period of 12 months from the completion date. This warranty covers defects in our installation or modification work.
5.2 Parts and Materials
Parts and materials used in upgrades carry manufacturer warranties. We will assist in warranty claims for defective parts.
5.3 Warranty Limitations
Our warranty does not cover:
- Normal wear and tear
- Damage caused by misuse or abuse
- Modifications made by third parties
- Pre-existing furniture defects
6. Limitation of Liability
To the maximum extent permitted by law, Ricamabbia's liability for any claim arising from our services is limited to the total amount paid for the specific service that gave rise to the claim. We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or business opportunities
- Personal injury not directly caused by our negligence
- Damage to existing furniture beyond normal wear from our services
7. Cancellation and Refund Policy
7.1 Customer Cancellation
- Cancellations made more than 48 hours before scheduled service: Full refund of deposit
- Cancellations made 24-48 hours before service: 50% refund of deposit
- Cancellations made less than 24 hours before service: No refund of deposit
7.2 Company Cancellation
If we must cancel your appointment, we will provide full refund and assist in rescheduling at your convenience.
8. Customer Responsibilities
As a customer, you agree to:
- Provide accurate information about your furniture and requirements
- Ensure safe access to furniture requiring modification
- Be present during service appointments or designate an authorized representative
- Follow care instructions provided for modified furniture
- Report any issues with our work promptly
9. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Ricamabbia and is protected by copyright and other intellectual property laws. You may not use our content without written permission.
10. Privacy and Data Protection
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.
11. Dispute Resolution
11.1 Informal Resolution
We encourage customers to contact us directly to resolve any disputes or concerns.
11.2 Formal Disputes
Any disputes that cannot be resolved informally will be subject to the laws of Ontario, Canada, and the exclusive jurisdiction of the courts of Ontario.
12. Force Majeure
We are not liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or pandemic-related restrictions.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of modified Terms.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
